1. Introduction

Welcome to Hido App, an on-demand booking platform providing authentic tourism experiences in Saudi Arabia. By accessing or using our services, you agree to be bound by these Terms & Conditions. Please read them carefully.These Terms of Service are a binding legal agreement between you and Hido that govern your use of the websites, applications, and other offerings from Hido. When used in these Terms, “Hido,” “we,” “us,” or “our” refers to Hido.

 

Services Provided 

The Hido Platform offers authentic local experiences, that enables users to publish, offer, search for, and book experinces. Users who offer and publish experiences are “Locals” and users who search for, book, or use experinces are “Tourists.” Locals offer local tours, adventures, events, hospitality, and other local services.

User Accounts

  • To access and use many features of the Hido App, you must create an account and keep your account information accurate.

  • You are responsible for safeguarding your password and agree not to disclose your password to any third party.

  • You agree to notify Hido immediately of any unauthorized use of your account.

Role of Hido 

As the provider of the Hido App, Hido does not own, control, offer, or manage any Listings or Local Services.

Hido is not a party to the contracts concluded directly between locals & tourists, nor is Hido a real estate broker or insurer.

Hido is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms of Service .

Bookings and Payments

  • All bookings made through Hido App are subject to availability and confirmation.

  • You agree to pay for all services booked through the app, including any applicable taxes and fees.

  • Payments are processed securely through our payment gateway, and you agree to the terms of use provided by our payment gateway.

Cancellations and Refunds

  • Cancellations must be made within the time frame specified for each service. Please refer to the specific cancellation policy at the time of booking.

  • Refunds will be processed according to the cancellation policy applicable to the service booked. Some services may be non-refundable.

 

Liability

  • Hido is not liable for any damages or injuries, including, without limitation, any failure of performance, errors, harassment, or any food related issues such as indigestion or food allergies, even in the event of negligence by Locals.

  • Your agreement to be bound by the terms and conditions of use is concluded once you use this site, meaning that you are fully responsible for yourself and those with you in the experience. Hido disclaims responsibility in the event of any psychological or physical harm, including sexual harassment.

 

Additional Terms and Policies

  • We maintain other terms and policies that supplement these Terms, such as our Privacy Policy, which describes our collection and use of personal data, and our Payments Terms, which govern any payment services provided to Members by the Hido payment entities (Hido Payments).

  • If you are a Local, you are responsible for understanding and complying with all laws, rules, regulations, and contracts with third parties that apply to your Local Experiences.

  • Other travel and tourism companies and/or similar entities are not permitted, while utilizing our App services, to utilize the data of experience owners for their own gain or to engage in contracts with experience owners outside Hido App, either during or after the completion of the experience.

  • All transactions and bookings with experience owners must be conducted exclusively through Hido App.

  • All interactions between travel and tourism companies and/or similar entities and the platform must be conducted with honesty and integrity.

  • If any part of this clause or other terms and conditions is violated, travel and tourism companies and similar businesses will be solely responsible.

 

Accuracy of Information

  • We have made every effort to reflect as accurately as possible in describing our experiences. However, we cannot and do not guarantee the accuracy or completeness of any information, including pictures of experiences and activities provided during an experience.

 

Quality of Services

  • We do not guarantee that the quality of our services, or any products, experiences, or information will meet your expectations.

Modifications and Discontinuation

  • We reserve the right at any time to modify or discontinue the experience (or any part or content thereof) without notice to you. We will not be liable to you or any third party for any modification or change in the experience, whether suspension or discontinuation of the experience.

  • We undertake no obligation to update, amend, or clarify information in the experience, including, without limitation, dates availability. There is no specified update or update date applicable to the Service, or this information has been modified or updated.

 

2. Rules

You must follow these rules and must not help or induce others to break or circumvent these rules:

  • Act with integrity and treat others with respect.

  • Do not lie, misrepresent something or someone, or pretend to be someone else.

  • Be polite and respectful when you communicate or interact with others.

  • Follow our Nondiscrimination Policy and do not discriminate against or harass others.

  • Only use Hido App as authorized by these Terms or another agreement with us.

  • Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.

  • follow the Saudi Ministry of health in protecting yourself and others during the experience from Covid.

  • Honor your legal obligations.

  • Understand and follow the laws that apply to you, including privacy, data protection, and export laws.

  • Do not use the name, logo, branding, or trademarks of Hido without permission.

  • Do not use or register any domain name, social media handle, trade name, trademark, branding, logo, or other source identifier that may be confused with Hido branding.

  • Do not offer Local Services that violate the laws or agreements that apply to you.

  • Do not offer or solicit prostitution or participate in or facilitate human trafficking.

 

3. Things are not allowed

  • Discussing or promoting political, diplomatic, or religious issues.

  • Insulting or ridiculing others, including children and people with special needs.

  • Any form of sexual content, discussion of personal relationships, or sexual preferences.

 

4. Hido Locals

  • As A Local, Hido offers you the opportunity to share your Experience with our vibrant community of Tourists - and earn money doing it. It’s easy to create an account and you are in control of how you will offer your experince as a local tour guide, host or amateur - set your itinerary, availability, price, location, and any deails required on app.

  • Contracting with tourists. When you accept a booking request, or receive a booking confirmation through Hido App, you are entering into a contract directly with the Tourist, and are responsible for delivering your Local Service under the terms and at the price specified in your experience. Any terms, policies or conditions that you include in any supplemental contract with Tourists must:

(1) be consistent with these Terms, our Policies, and the information provided in your local Service.

(2) be prominently disclosed in your experience description.

  • Independence of Locals. Your relationship with Hido is that of an independent individual or entity and not an employee, agent, joint venturer, or partner of Hido. Hido does not direct or control your Local experiences, and you agree that you have complete discretion whether and when to provide Local experiences, and at what price and on what terms to offer them.

  • Locals as local guides must ensure that every itinerary which will be offered to Tourists have a ticket or a privilege to go there.

  • Locals as local guides must Provides everything related to the local tour, including transportation, hospitality, entry tickets to attractions, and restaurants, etc. So the price includes everything that locals provid.

  • Locals may not organize an event if on self-quarantine, or suffering from any transmissible or infectious disease or illness, or experiencing any symptoms of COVID-19, (or related illness).They need to comply with the local Covid -19 test regulation.

  • Locals must ensure that all areas which may be visited by Tourists are adequately disinfected before any Hospitality or local event.

  • Locals when they host must follow MOH guidelines for handwashing; including washing hands before, during, and after preparing or serving food, also wear facial Mask if they need to.in addition to offering single-use napkins/ towels should be available in restrooms and handwashing areas throughout each hospitality. 

  • Locals are recommended to host in outdoor spaces, if available.

  • Event size limitations set by local authorities must be followed.

 

5. Hido Tourists

  • Tourists may not attend an experince if on self-quarantine, or suffering from any transmissible or infectious disease or illness, or experiencing any symptoms of COVID-19 (or related illness).

  • Tourists may only visit areas which the Local has indicated are intended to be visited.

  • Your Responsibilities. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Experience or other Local Service. For example, this means:

  1. you are responsible for leaving a hospitality place (and related personal property) in the condition it was in when you arrived.

  2. you must act with integrity, treat others with respect and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to a Local Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

  3. If you have any type of food allergy, you must inform the Local when you book his experience.

  • Your Assumption of Risk: 

  1. ​​​​​​​You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of Hido App , including your  participation in any Experience, use of any other Local Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Local Service to determine whether it is suitable for you. For example, Local Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Local Services.

  2. Where required in order to comply with the Protection Guidelines, Tourists should wear appropriate facial coverage.

  3. Tourists should cooperate with the Local in taking appropriate action to comply with these guidelines and the Protection Guidelines.

  4. Tourists accept that they are responsible for their own conduct.

  5. Tourists understand that attending Hospitality, Adventures or events has associated risks and whilst reasonable efforts may be expected to be made to reduce those risks they cannot be eliminated. Tourists waive any right to claim for any infection contracted whilst attending any local experinces (except to the extent that the infection is contracted as a result of the gross negligence of the Local).

  • ​​​​​​​Your obligation to leave your Local once the experiences are finished,Under no circumstances shall we be held responsible in the event that you do not respect this obligation. You agree to take personal responsibility in the event of a claim by a third party or by your Local host in the adventure, hospitality or event that you do not respect this obligation. You also guarantee us against any claim by a third party or by your Local in this respect.

  • Respect for neighbors and other members of your Local host's household,You agree to respect your Local host's neighbors and not to behave in such a way that may cause any nuisance, particularly noise, to be suffered by neighbors in the course of a Hido Experinces. Under no circumstances shall we be held responsible in the event that you do not respect this obligation. You agree to take personal responsibility in the event of a claim by a third party in the event that you do not respect this obligation. You also guarantee us against any claim by a third party in this respect.

 

 

6. Payments Terms

  • These Payments Terms of Service for Users (Payments Terms) are a binding legal agreement between you and Hido Payments that govern the Payment Services (defined below) conducted through or in connection with Hido App. When these Payments Terms mention “we,” “us,” or “our,” it refers to Hido App  you are contracting with for Payment Services.

  • Hido Payments provides payments services to Members publishing, offering Experiences or other Local Services, and other current and future services. These payment services may include :

  1. Collecting payments from Tourists , by linking Hido App with Online Payment gate.

  2. Your Payment Method, Your Responsibility. Hido App is not responsible for any loss suffered by you as a result of incorrect Payment Method information provided by you.

  • Booking Request Status. If a requested booking is declined either because it is not accepted by Local or you cancel the booking request before it is accepted by the Local, any amounts collected by Hido App will be refunded to you, and any pre-authorization of your Payment Method will be released (if applicable).

1- If the experience is canceled by the Local, the full amount will be paid to the Tourist.

 

2- If the experience is canceled by the Tourist at least a day before the experience, the full amount will be refunded.

 

3-  If the experience is canceled by the Tourist less than a day before the experience, half of the amount will be returned to the Tourist.

  • Payment Service Providers. Payment Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing payments in connection with the Payment Services, and Hido App is not responsible for any such fees and disclaims all liability in this regard. Your Payment Method may also be subject to additional terms of use. Please review them before using your Payment Method.

  • The timing to receive the refund or for the pre-authorization to be released will vary based on the Payment Method and any applicable payment system (e.g., Visa, MasterCard, etc.) rules.

  • dding a Payment Method. When you add a Payment Method to your Hido account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Hido App or its third-party payment processor(s). You authorize Hido App and its payment service providers to collect your Payment Method information.

  • When issuing Hido experinces Locals state the fees that they will charge each Tourist, these fees are quoted inclusive of all sales and analogous or other taxes (the “Local’s Charges”).Hido arranges a service for these fees to be collected and held in a third-party trust account on terms that the funds will be paid in accordance with these T&Cs 

  • Where applicable, the Hido Fees are calculated as a variable percentage of the Local’s Charges.Any Hido Fees are payable by the Tourists at the same time as payment of the Local’s Charges.To the extent that the Hido Fees are subject to sales taxes, such as VAT, these taxes will be included in the total amount payable by the Tourist in respect of the Transaction Fees. 

  • Locals agree and acknowledge that they are responsible for discharging all of their own tax obligations (including sales taxes including, but not limited to, VAT) whether these are imposed on a state, local or other level. Hido assumes no obligations whatsoever in this regard. In particular, Hido assumes no responsibility (actual or deemed) to notify or explain to Locals, or to enquire into, the VAT or sales taxes treatment of any Locals.

  • If Hido so requires for the purposes of its dealings with any tax or regulatory authority, Locals and Tourists shall provide to Hido, promptly on request.

  • Locals shall, promptly on request, provide to Hido all reasonable assistance in any discussion or dispute with any tax authority with respect to the VAT or sales tax treatment  which those Locals have participated.Each Locals agrees to indemnify Hido for any VAT or similar sales tax obligations which Hido is required to pay.

  • Any dispute or claim arising out of or in connection with Hido App shall be governed and construed in accordance with the laws of Saudi Arabia. 

  • Saudi Arabia is our country of domicile.

  • We accept payments online using Visa and MasterCard credit/debit card in SAR.
